1. Acceptance of Terms

By accessing and using the DBase IRC Network ("the Network", "we", "us", "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

DBase IRC Network is an Internet Relay Chat (IRC) network founded in 2008, originally established as X-Serv before being rebranded to DBase Network. We provide a technology and music-oriented community platform focused on ethical hacking, programming, system administration, and open-source development.

3. User Accounts

3.1 Account Registration

You must provide accurate and complete information when creating an account
You are responsible for maintaining the security of your account credentials
You must be at least 13 years old to use our services
One person or entity may maintain only one account

3.2 Account Responsibilities

You are responsible for all activities that occur under your account
You must immediately notify us of any unauthorized use of your account
You may not share your account credentials with others
You may not use another user's account without permission

4. Acceptable Use

4.1 Prohibited Activities

You agree NOT to use the Network to:

Violate any applicable laws or regulations
Infringe upon the rights of others
Transmit any harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
Distribute malware, viruses, or other harmful code
Engage in spamming, flooding, or other disruptive activities
Attempt to gain unauthorized access to systems or accounts
Impersonate other users or entities
Collect or harvest user information without consent
Use automated scripts or bots without authorization

4.2 Ethical Hacking and Security

Security research and ethical hacking discussions are welcome
Any actual exploitation or attacks against systems is strictly prohibited
Sharing of tools or techniques must be for educational purposes only
We reserve the right to report illegal activities to law enforcement

5. Content and Intellectual Property

5.1 User Content

You retain ownership of content you post on the Network
By posting content, you grant us a license to display and distribute that content on the Network
You are responsible for ensuring you have the right to post any content you share

5.2 Network Content

All Network software, design, and branding are the property of DBase IRC Network
You may not copy, modify, or distribute Network content without permission
Open-source components are subject to their respective licenses

6. Privacy

Your use of the Network is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices.

7. Service Availability

7.1 No Guarantees

We do not guarantee uninterrupted or error-free service
We reserve the right to modify, suspend, or discontinue any part of the service at any time
We are not liable for any loss or damage resulting from service interruptions

7.2 Maintenance

We may perform scheduled or emergency maintenance
We will attempt to provide notice of significant maintenance when possible

8. Termination

8.1 By You

You may terminate your account at any time by contacting network administrators.

8.2 By Us

We may suspend or terminate your account immediately, without prior notice, if:

You violate these Terms of Service
You engage in illegal activities
You disrupt the Network or other users
Required by law or court order

9. Disclaimers

THE NETWORK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DBASE IRC NETWORK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify and hold harmless DBase IRC Network, its operators, administrators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Network or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes via the Network or email. Your continued use of the Network after changes constitutes acceptance of the new terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Serbia, without regard to its conflict of law provisions.

15. Severability

By using DBase IRC Network, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
